By submitting a Supplier Verification application, the Applicant agrees to the following terms.
1. Verification Service
NDAA.com provides an independent, document-based and risk-based supplier verification service.
Depending on the information and documents submitted, NDAA.com may review company registration and legal existence, business address, ownership and control, Covered Nation-related ownership and control, government or state-owned enterprise relationships, restricted-entity status, quality, cybersecurity, manufacturing, or other supporting certifications, and other information selected by the Applicant for verification.
The specific areas reviewed will be shown in the Applicant's Verification Coverage .
NDAA.com is not a U.S. Government agency, and an NDAA.com verification is not a U.S. Government certification.
2. Covered Nation-Related Ownership and Control
For purposes of NDAA.com Supplier Verification, Covered Nations include:
- Democratic People's Republic of Korea (North Korea)
- People's Republic of China (PRC)
- Russian Federation
- Islamic Republic of Iran
Where requested, the Applicant must disclose known direct or indirect ownership, beneficial ownership, government involvement, or material control associated with a Covered Nation.
Such ownership or control does not , by itself, mean that the Applicant or its products violate the NDAA or other U.S. law.
NDAA.com may use this information as part of its risk-based verification methodology together with applicable ownership, control, restricted-entity, product, component, and procurement requirements.
3. Applicant Certification
The Applicant certifies that, after reasonable internal inquiry, all information and documents submitted are true and accurate, complete in all material respects, and not misleading in any material respect.
The Applicant agrees not to knowingly conceal or misrepresent material information concerning corporate identity, ownership or beneficial ownership, control rights, Covered Nation-related ownership or control, government or state-owned enterprise relationships, or applicable restricted-entity relationships.
The Applicant must notify NDAA.com within 30 calendar days after becoming aware of a material change that could reasonably affect its verification.
4. Verification Rights
The Applicant authorizes NDAA.com to verify submitted information using lawful sources, including government and corporate registries, public records, certification issuers, commercial compliance databases, applicable U.S. Government restricted or designated-entity sources, and authorized third-party verification providers.
NDAA.com may request additional information where submitted information is incomplete, inconsistent, or requires further review.
5. Data Use & Privacy
NDAA.com may collect and process information reasonably necessary to provide its verification services, including corporate information, ownership and control declarations, submitted documents, business contact information, signatures, verification results, and review records.
Information may be used for verification and screening, fraud or misrepresentation detection, audit and recordkeeping, verification renewal or status management, security, dispute handling, and compliance with applicable law.
NDAA.com may use authorized service providers for form hosting, secure storage, OCR, AI-assisted document analysis, entity screening, security, and related services.
Applicant information may be processed in the United States, Taiwan, or other jurisdictions in which authorized service providers operate.
NDAA.com does not intend to sell confidential verification documents or publicly disclose confidential supporting documents solely because they were submitted for verification.
6. AI and Automated Processing
NDAA.com may use automated or AI-assisted tools for OCR, document classification, information extraction, entity matching, ownership-structure analysis, inconsistency detection, and restricted-entity screening.
Automated extraction or analysis does not by itself mean that information has been independently verified. Final verification determinations may be subject to human review.
7. Misrepresentation, Suspension and Revocation
If NDAA.com identifies a material inconsistency or suspected misrepresentation, it may request clarification or additional evidence, conduct additional review, temporarily suspend verification, or restrict use of the applicable verification status.
If material or intentional misrepresentation is confirmed, NDAA.com may reject, suspend, or revoke the verification, update the public verification status, require the Applicant to stop using NDAA.com badges or certificates, refuse renewal, and seek reasonable investigation, remediation, or legal costs where permitted by applicable law.
Minor clerical errors that do not materially affect the verification result will not, by themselves, constitute intentional misrepresentation.
8. Verification Limitations
An NDAA.com verification reflects only the scope of information and documents reviewed at the time of assessment.
It does not constitute legal advice or U.S. Government or Department of Defense approval; guarantee compliance with every provision of the NDAA, FAR, DFARS, sanctions, export-control, or procurement law; guarantee eligibility for a specific government contract; guarantee discovery of intentionally concealed information; or mean that every product of a verified supplier has been independently reviewed.
Supplier Verification and Product Verification are separate unless expressly stated otherwise.
9. Liability
To the maximum extent permitted by applicable law, NDAA.com is not responsible for losses caused by information that the Applicant intentionally concealed, falsified, or materially misrepresented where such information could not reasonably have been identified within the applicable verification scope.
The Applicant may be responsible for reasonable costs or third-party claims resulting from its own material misrepresentation, falsified documents, or unauthorized use of NDAA.com verification marks.
